V.     Minutes: 

A.  Move that the minutes of the July 20, 2007 Town Council meeting and closed session be approved, as recorded.

B.  Move that the minutes of the August 7, 2007 Town Council meeting and closed session be approved, as recorded and that the closed session minutes be sealed.

VI.       Licenses and Permits: To consider and act upon the following matters:        

A.  Consider approving a Special Event License and a 1-day Full Privilege Liquor License for the Smithfield Sportsman’s Club for their annual field day to be held on September 16, 2007 from 9:00 a.m. to 8:00 p.m. pending compliance with all state regulations and local ordinances. Rain date will be on September 23, 2007.   (Fee Waived for Special Event License Only).

B.  Consider approving a Special Event License for Buonthanh Prasavath Watlao Buddhovath of Rhode Island Inc. for an event to take place at the Buddhist Temple, 88 Limerock Road on Saturday, September 8 and Sunday, September 9, 2007 pending compliance with all state regulations and local ordinances and restrictions set forth through an agreement with the Smithfield Police Department except as it relates to the sale of alcohol.

C.  Consider approving two (2) 1-Day Beer and Wine Licenses for Thongkhoun Pathana d/b/a “Laotian Community Center”, 88 Limerock Road, for an event to take place on Saturday, September 8 and Sunday, September  9, 2007 pending  compliance with all       state regulations and local ordinances and restrictions set forth through an agreement  between the Laotian Community Center and the Town of Smithfield.    

D.  Consider approving a new Massage Establishment License for Rhonda Rohelia d/b/a “Soothing Touch Spa” to be located at 180 Pleasant View Avenue,  pending compliance with all state regulations and local ordinances and subject to final approval from the Building Official.

E.   Consider approving a Massage Therapy License for Shirley J. McCartin, 175 Carter Avenue, Pawtucket, to administer therapeutic massage at the Soothing Touch Spa located at 180 Pleasant View Avenue, pending compliance with all state regulations and local ordinances and subject to the final approval of the establishment by the Building Official.  

F.   Consider approving the renewal of three (3) Pool Table Licenses for the following establishments pending compliance with all state regulations and local ordinances.

1.      Bryant University Student Center, 1150 Douglas Pike

2.      Gilda Poirier d/b/a “Gilda’s Lounge”, 28 Farnum Pike

3.      Portuguese American Club, 32 Fenwood Avenue

4.      Cat-Beau Inc., d/b/a “Tickers”, 45 Cedar Swamp Road

VII.      Public Hearings:  To consider and act upon the following matters:   NONE

VIII.     Old Business:  To consider and act upon the following matters:

A.   Consider accepting “Roadway B” as a Town road to be named “DeCotis Farm Road”  subject to the Traffic Safety Committee authorization.

B.  Consider discussion on the following: Due to violations of specific prohibitions enumerated in §2.06(b) and §2.06(c) of the Town Charter, the Town Council President has forfeited his office or consider acting upon adopting a procedure with regard to charter violations and/or scheduling a public hearing on charter violations.

IX.       New Business:  To consider and act upon the following matters:

A.  Consider that the Town of Smithfield deny the claim of petitioner, Mr. Matthew Thomas and refers this matter to the Town Solicitor and the R.I. Interlocal Risk Management Trust.

B.  Consider that the Town of Smithfield deny the claim of petitioner, Ms. Jessica Williams and refers this matter to the Town Solicitor and the R.I. Interlocal Risk Management Trust.

C.   Town Hall Extended Hours/Accessibility.

D.   Consider authorizing a bid award for Maplecrest Sewers.

E.   Consider and act upon a Resolution authorizing Sewer Extension and Real Property Assessment with respect to Maplecrest Drive.

F.   Consider introduction and scheduling of a Public Hearing for September 18, 2007 to consider Amendments to Chapter 122, Amusements, Coin-Operated, of the Smithfield Code of Ordinances § 122-2. Definitions (Arcade);  § 122-5 Arcade License required;  § 122-8. Denial of License ( C ) and (H);  § 122-9 Grant of License and § 122-1.  License for business with one device, and  § 122-11 (G).

G.  Consider appointing a Search Committee for the vacant Town Manager position.

H.  Consider authorizing a bid award for a security surveillance system for the Department of Public Works.

I.    Consider a request to advertise sale of Surplus and Obsolete property, pursuant to Town Charter Section 81-9.

J.   Consider approving a RI DOT Construction and Maintenance Agreement for “Emergency Vehicle Priority Control “ (Traffic Signalization) for Route 7 at Route 116 and Route 7 at Essex Street intersections.

K.  Consider approving a Mutual-Aid Agreement with Lincoln Water District.

L.   Consider a discussion of contractual employees.

M.  Consider and act upon Town Policy and Procedure for Access to Public Records.

N.  Consider a discussion of a consultant agreement for Richard Geldard.

O.  Consider approving abatements and addenda as recommended by Tax Assessor:  NONE

P.   Consider possible appointments to boards or commissions: 

1.      Smithfield-Johnston Juvenile Hearing Board

Q.  Consider a possible motion to go into closed session pursuant to Section 42-46-5(a)(2),  Collective Bargaining and Litigation, Geraldine DeAngelis vs Town of Smithfield, Leonard King vs Smithfield Zoning Board, Section 42-46-5 (a)(5), Real Estate, Section 42-46-5(a)(1), Personnel, and Section 42-46-5(a)(3), Security, of the RI General Laws.

R.   Reconvene in open session, if necessary, to announce any closed session votes required to be disclosed pursuant to RI General Laws, Sec. 42-46-4.
