TOWN OF SMITHFIELD
NEW ORDINANCES AND ORDINANCE AMENDMENTS ADOPTED
BY THE SMITHFIELD TOWN COUNCIL
YEARS:  2009 - 2010

Notice is hereby given that the Town Council of the Town of Smithfield, pursuant to the provisions of Article II, Section C-2.13 (b) of the Home Rule Charter of the Town of Smithfield, has adopted the following Ordinance Amendments:

Year 2010

#2010-01 – Chapter 48, FINANCIAL REVIEW COMMISSION ORDINANCE

Section 48-1 - Established, through to Section 48-8 – Dissolution of Financial Review Board.  Membership, organization, quorum, duties and purpose, and advisory nature of Commission. 

Adopted:  January 19, 2010.

 

#2010-02  Chapter 51, AFFORDABLE HOUSING ADVISORY BOARD ORDINANCE AMENDMENT
Sections 51-2 and  51-4, membership and quorum. Adopted on:  February 16, 2010.
 
#2010-03  Chapter 321, TAXATION (Public Water Tanks)
Chapter 321, Article II, Tax Exemptions, Section 321-11.2 Public Water Tanks.  Water tanks owned by Lincoln Water Commission and Greenville Water District shall be exempt from local property taxation. 
Adopted on:  February 16, 2010.
 
#2010-04 – Chapter 102 TRAFFIC SAFETY COMMISSION ORDINANCE AMENDMENT
Traffic Safety Commission, Section 102-1 to Section 102-3, creation; powers and duties, publication.
Adopted on:  February 16, 2010.
 
#2010-05 – Chapter 154 – BUILDING CONSTRUCTION
Section 154-7 Demolition Order:  The Building Official, when issuing an order requiring the demolition of a building or structure, shall also serve on the owner thereof written notice of the a) right to appeal, b)  right of owner to provide a structural engineer report;  c) right of owner to seek advice and assistance from social service agencies. Adopted on:  April 20, 2010.
 


Year 2009

#2009-01 - Chapter 236 – Licensing, Business - Registration of Commercial and Manufacturing Businesses  §236-13. Regulations. Change to reflect necessary payment of municipal tangible taxes prior to processing annual business registration. Ordinance amendment adopted on January 6, 2009.

#2009-02 – Chapter 126 – Animals, Article V, Animal Control  § 126-35 Cremation. Fees are Town Residents - $20.00; Non-residents - $30.00; Veterinarians - $50.00, with veterinarians inability to charge a higher fee to dog owners. Ordinance adopted on January 20, 2009.

#2009-03 – Chapter 204 – Special Flood Hazard Areas and Flood Fringe Lands, Article I, General Provisions  Chapter 204, entitled Flood Damage Prevention, is repealed in its entirety. New title and language (§204-1 through §204-10) reflect updates required by U.S. Federal Emergency Management Agency. Ordinance adopted on January 20, 2009, effective March 2, 2009.

#2009-04 – Chapter 258 – Outdoor Hydronic Heaters – Outdoor Wood Boilers
§258-1 through §258-8. New Ordinance regulates location, use, construction and operation of outdoor furnaces to provide safety and avoid public nuisance. Ordinance adopted on January 20, 2009.

#2009-05 - Chapter 198, Part 5, Fire Prevention, Article XX – False Alarms
§198-152 through §198-158. Amendments to clarify language to reflect changes to definitions and requirements for false alarm fees, fee allocation, fee penalties, and the responsibilities of the property owner. Ordinance adopted February 17, 2009.

#2009-06 (SPECIAL) Ordinance of October, 2007,  Place into Code Book, Per Town Solicitor E. Alves January, 2009) --  Under new Article V Section, as follows: Article V, Sewer Revenue Bonds , §294-34 Sewer Revenue Bond, Maplecrest Drive Sewer Extension Project.

#2009-07  (SPECIAL)  Annual Financial Town Meeting held on May 13, 1999 Place amended §81-7 B, Purchasing, into Code Book, Per Town Finance Director R. Rossi.  Only change:   B. Bids over $5,000 $10,000 (new approved amount) and in body of text. 

#2009-08 Chapter 60, Sections 1-12.  Municipal Court Ordinance Amendments, Adopted March17, 2009.  To delay implementation of the Court and reflects revisions mandated by recent Charter amendments. 

#2009-09 Charter Amendments (as voted and approved through November 4, 2008 Town Election) 

#2009-10 Chapter 118 – ALCOHOLIC BEVERAGES, adopted on Tuesday, May 5, 2009. Article IV. Alcohol Server Training.  Section 118-8:  Requirements for alcohol server training and license compliance. Section 118-10: Penalty provisions and mandatory fines for all liquor violations. 

#2009-11 Chapter 294 – SEWERS, adopted by Town Council on Tuesday, May 5, 2009.  Article III: User Charges. Section 294-17  Computation – Section A. Generally -Sewer User Charges - through Section G.  Sewer meters.  Proposed amendment to reflect R.I. Dept. of Environmental Management’s mandatory changes to reflect update to the definition of significant noncompliance and the national pre-treatment streamlining rules.

#2009-12  Section A361  -  Smithfield Sewer Authority Amended Rules & Regulations

#2009-13 Section 70-21 Personnel Board – Amendment reflects that in accordance with Home Rule Charter Section 4.18, the Town Council re-assigns functions  to the Town Manager.  Adopted:  June 23, 2009 

#2009-14 Chapter 126, Article 5, Animal Control, Section 126-34-B, Nuisance Abatement.   Adopted:  July 15, 2009. 

#2009-15  Woodland Conservation Ordinance.  Amend existing Chapter 333 “Trees.” Add new Chapter 333 entitled “Woodland Conservation” which reflects further preservation, maintenance, and tree clearance definitions and applications.  Adopted:  September 1, 2009,  Effective October 2, 2009.

#2009-16  Sewer Projects (Kimberly Ann Drive and Flow Monitoring Study) Revenue Bond Ordinance.   Adopted:  August 12, 2009. 

#2009-17 Historic Preservation Amended Ordinance.  Adopted:  August 11, 2009.

#2009-18  Liquor License Ordinance, Chapter 118-12, Alcohol Beverages Prohibited. Amendment ensures that no alcohol beverages are consumed on the holder’s licensed premises unless the Town Council has issued a liquor license for the licensed premises;  which license is in full force and effect.   Adopted:  September 15, 2009, Effective October 15, 2009.

#2009-19 Noise Ordinance Chapter 252, Noise, Article I, Noise Regulations, Sections 252-1 to 252-11, definitions, registration, regulations, violations and penalties.  Adopted on:  October 20, 2009. 

#2009-20 Energy Review Commission Ordinance Chapter 47, Energy Review Commission, Sections 47-1 to 47-7,  to establish, organization, membership, quorum, duties and purposes, advisory nature of Commission, and dissolution of Smithfield Energy Conservation Committee.  Adopted on:  November 17, 2009.
